Two cases of violation of public interest established upon inspection of dams

Two consecutive inspections of dams have established that public interests within the meaning of the Water Act have been violated during activities in the dam basin, whereby a prerequisite has been created for negative impact on the reservoir rims, the facilities, water quality, and protected areas.

 On inspection of the “Pech” quarry in the village of Gara Oreshets, Municipality of Dimovo, experts from the Danube Region Basin Directorate - Pleven, in the presence of the deputy mayor of the municipality, established that water from the “Varbovchets” dam was used for irrigation of roads utilized for the extraction of rock mass. It was established that this was done with two water tanks, under a contract between the Municipality of Dimovo and “Avtomagistrali” EAD for uncharged use of a dam in municipal property, presented by the drivers of the tank trucks as grounds for water abstraction.

 The company - providing the equipment on rent, is to be presented with an act establishing an administrative violation. The invitation for imposing the administrative penalty explicitly states that the contract in question does not constitute grounds for water abstraction. According to the Water Act, water abstraction from the “Varbovchets” Dam requires a permit for water abstraction, without which the abstraction of water from the dam is subject to administrative and penal liability.

 Violation of the public interest as a result of agricultural cultivation of the lands in the reservoir of the “​​Asparuhov Val” dam was found during the inspection by Deputy Minister Petar Dimitrov. The dam is located in the lands of the town of Kozloduy, Kozloduy Municipality, and the villages Zlatia and Razgrad, Vulchedrum municipality. The owner – “Irrigation Systems” EAD, was notified of the day and time when  the act establishing an administrative violation will be issued. The case, including the activities to destroy the dam’s reservoir, has been handed over to the Montana District Attorney’s Office.
